General Terms and Conditions for the Hotel Industry (AGBH 2006 / ÖHGB)
In addition to the house-specific notes below ('Good to Know'), the General Terms and Conditions for the Hotel Industry 2006 (AGBH 2006), adopted by the Hotel Association of the Austrian Federal Economic Chamber, apply. Excerpt of the key provisions:
§ 1 Scope of Application
These terms apply to contracts on the rental of hotel rooms for accommodation as well as all related services and supplies provided by the hotelier to the guest. Deviating conditions of the guest are not recognised unless the hotelier expressly agrees to them in writing.
§ 2 Conclusion of Contract – Deposit
The accommodation contract is concluded upon acceptance of the guest's order by the hotelier. For online bookings via our booking system (Seekda), acceptance takes place by automated booking confirmation by email. The hotelier is entitled to request a reasonable deposit.
§ 3 Beginning and End of Accommodation
The guest has the right to occupy the rented rooms from 2:00 PM on the agreed day. If the guest has not occupied the rooms by 6:00 PM, the hotelier is entitled to allocate the rooms otherwise, unless a later arrival time has been expressly agreed. The rented rooms must be vacated by 11:00 AM on the day of departure.
§ 4 Withdrawal from the Contract – Cancellation Fee
Up to 3 months before the agreed arrival day, the contract may be terminated unilaterally by the guest free of charge. Outside this period, withdrawal is only possible upon payment of the agreed cancellation rates (see cancellation policy below). In the event of non-utilisation of the service ('no-show'), the full accommodation price is payable.
§ 5 Provision of Substitute Accommodation
The hotelier may provide the guest with adequate substitute accommodation (of the same quality) if this is reasonable for the guest, in particular if the deviation is minor and objectively justified.
§ 6 Rights of the Guest
By concluding an accommodation contract, the guest acquires the right to the customary use of the rented rooms, of the facilities of the accommodation establishment that are usually and without special conditions available to guests, and to customary service. The guest must exercise their rights in accordance with hotel customs (house rules).
§ 7 Obligations of the Guest
The guest is obliged to pay the agreed prices plus any additional amounts incurred by separate use of services by them and their accompanying persons, plus statutory VAT, no later than at the time of departure. The guest is liable for any damage caused by them, their companions, third parties with their consent, or their animals.
§ 8 Rights of the Hotelier
If the guest refuses to pay the agreed remuneration or is in arrears, the hotelier has the statutory right of retention pursuant to § 970c ABGB and the statutory lien pursuant to § 1101 ABGB on the items brought in by the guest.
§ 9 Obligations of the Hotelier
The hotelier is obliged to provide the agreed services to the locally customary extent. Special services for which a separate fee is charged must be announced by notices in the hotel (e.g. reception, room).
§ 10 Liability for Damage to Brought-in Items
The hotelier is liable pursuant to §§ 970 et seq. ABGB for items brought in by the guest. Liability is excluded if the damage is caused by the guest, persons accompanying them, or by force majeure. Liability is limited to the maximum amount stipulated in the Ordinance Federal Law Gazette No. 638/1921 as amended. Valuables, money and securities can be kept in the hotel safe up to a maximum amount of € 550; any liability beyond this is not assumed.
§ 11 Liability Limitations
In the case of a breach of contract due to slight negligence, the hotelier's liability is excluded, unless personal injury is involved. If the Austrian Consumer Protection Act (KSchG) applies, the above liability limitations do not apply.
§ 12 Animals
Animals may only be brought into the accommodation establishment with prior consent of the hotelier and against a special fee. The guest must keep their animal properly supervised during their stay.
§ 13 Extension of Accommodation
The guest has no entitlement to an extension of their stay. Occupation of the room beyond the agreed length of stay does not constitute a contract.
§ 14 Place of Performance, Jurisdiction and Choice of Law
The place of performance is the location of the accommodation establishment. For disputes – as far as legally permissible – exclusively the court with subject-matter jurisdiction at the registered office of the establishment (Regional Court of Krems an der Donau) is competent. Austrian substantive law applies, excluding conflict-of-laws provisions and the UN Convention on Contracts for the International Sale of Goods.
§ 15 Miscellaneous
Should individual provisions of these terms be ineffective or void, this shall not affect the validity of the remaining provisions. For accommodation contracts with consumers within the meaning of the KSchG, the above provisions apply only insofar as the KSchG does not mandatorily prescribe otherwise.
